Alternative Attorneys

Conditions

The Principal must decide the circumstances in which the LifeDocs Enduring Power of Attorney will operate.

Commencement(Required)

The Principal may choose whether the LifeDocs Enduring Power of Attorney starts immediately, so the Attorney(s) can make decisions straight away, or only after the Principal loses the ability to make decisions for themselves.

Authorisation(Required)

The Principal may decide from the options listed below the type and extent of the power granted under this LifeDocs Enduring Power of Attorney.

Anything on my behalf I can lawfully do – Grants your attorney(s) comprehensive authority to make both personal and financial decisions on your behalf.
Personal matters only – Allows your attorney(s) to make decisions about your lifestyle and personal matter, but not your financial affairs. For example, access to support services or where you live.
Financial matters only – Empowers your attorney(s) to manage your financial and property matters, but not personal decisions. For example, paying bills or investing and selling assets.
Specify – Enables the Principal to customise the powers granted to the attorney(s), tailoring the authority to the Principal’s specific needs and preferences.

Specific Authorisation(Required)

You should be as specific as possible when completing this section. As an example, the Principal may only want to grant the Attorney(s) with authority to sign all documents relating to the sale of a specific property.

Impose Conditions or Provide Instructions?(Required)

Here the Principal may elect to impose additional conditions on the Attorney(s) when they exercise their powers. For example, if Attorney have authority to deal with financial matters, the Principal may impose an condition on the Attorneys that they obtain advice from a suitably qualified financial adviser prior to exercising any powers relating to the Principal’s financial affairs where the amount is greater than $10,000.

You should be as specific as possible when completing this section. As an example, the Principal may include an instruction that their father must be consulted prior to the Attorney exercising any power.
